FIRE PREVENTION

§ 12-1.  Adoption of Administrative Code provisions.

A.     Except as otherwise specifically provided in this chapter, the Wisconsin Administrative Code provisions which pertain to fire and/or fire department regulations as found in the following chapters and sections, exclusive of any regulations for which a statutory penalty is a fine or term of imprisonment, are hereby adopted and by reference made a part of this chapter as if fully set forth herein, said chapters and provisions being as follows:

(1)    Chapters COMM 8, COMM 69, COMM 160 to 164, and COMM 221.

(2)    Sections COMM 6.07 and 12.70.

(3)    Chapters COMM 7, 11, 12, 13, 14, 15, 32, 34, 50, 51, 52, 53, 54, 55, 56, 57, 58, 59, 60, 61, 62, 63 and 64.

(4)    Sections NR 5.11 and 30.07.

(5)    Section HFS 124.27(4) and Chapter HFS 195.

B.     Any act required to be performed or prohibited by any Administrative Code regulation incorporated herein by reference is required or prohibited by this chapter. Any future amendments, revisions, or modifications of the regulations incorporated herein are intended to be made part of this chapter in order to secure uniform state-wide regulation of fire regulations of the State of Wisconsin.

§ 12-2.  Parking near or obstructing fire hydrants.

It shall be unlawful for any person to park any vehicle, or leave any obstruction, within 10 feet from any fire hydrant.

§ 12-3.  Driving over fire hoses.

It shall be unlawful for any person in any kind of vehicle to drive over any fire hose, except where the same is properly protected and by permission of the Fire Chief.

§ 12-4.  Parking near fire.

It shall be unlawful to drive into or park any vehicle within the block where fire apparatus has stopped in response to an alarm.

§ 12-5.  Following fire truck.

It shall be unlawful for the operation of a vehicle, other than one on official business, to follow any fire truck or vehicle carrying any fire apparatus in response to a call or alarm closer than 500 feet.

§ 12-6.  Chief shall have police authority.

The Chief of the Fire Department and his assistants shall have police authority, and orders given by them must be obeyed and complied with.

§ 12-7.  Children to keep away.

Children under 16 years of age, not accompanied by their parents or guardians, shall not come within one block of the scene of fire without the permission of the Chief of the Fire Department, nor shall children get on any vehicle en route to the fire.

§ 12-8.  Resistance to firemen.

It shall be unlawful for any person willfully to offer any resistance or hindrance to any fireman in the discharge of his duty.

§ 12-9.  Destruction of property to prevent spread of fire.

During the progress of any fire, the Chief of the Fire Department, or in case of his absence or disability the Assistant Chief, shall have the power to order the removal or destruction of property necessary to prevent the further spread of fire.

§ 12-10.  Burning permits.

Burning permits shall be issued for the following materials: brush, leaves, personal papers, and clean, unpainted wood products.

A.     Issuance. Permits will be issued by the Fire Department.

B.     Below-ground fire pits. Fire pits shall be below ground level. The pit shall not exceed 16 square feet and shall be surrounded by a noncombustible material (i.e., concrete, brick, stone, metal, dirt or sand; grass is not considered an acceptable barrier). Only clean wood is to be burned. A burning permit is not required.

C.     Aboveground fire pits. Burn clean wood only. The burning chamber shall not exceed 16 square feet or three feet in height from the ground level. A burning permit is not required.

D.     Burning containers. Burning containers are to be constructed of metal and must be covered by a metal screen or netting. The burning container shall not be larger than a fifty-five-gallon barrel in size. A burning permit is not required.

E.      Ground fires. Ground fires shall be permitted, provided that the burning material is located away from any other combustible materials. A burning permit is required.

F.      Leaves. No person shall burn leaves on a City street or sidewalk at any time, and no permit shall be given for the burning of leaves on a City street or sidewalk.

G.     Hours. Burning will be allowed between the hours of 8:00 a.m. and 12:00 midnight, Monday through Friday, and Saturday 9:00 a.m. to 12:00 midnight. No burning is permitted on Sundays or holidays.

H.     Regulations.

(1)    All fires listed above shall be no closer than 20 feet to any structure, including decks, nor closer than 10 feet to any property line.

(2)    All fires shall be attended by an adult at all times until they are extinguished ("adult" means age 16 and older).

(3)    The person attending the fire shall have one or more of the following extinguishing tools: shovel, rake, garden hose, bucket of water, sand or dirt, or fire extinguisher.

(4)    Any person causing property damage due to carelessness or neglect may be held financially responsible for any costs incurred.

§ 12-11.  Violations and penalties.

Any person who violates any provisions of this chapter shall, upon conviction thereof, pay a fine or forfeiture to the City of Gillett in an amount as provided in Chapter 1, Article II of this Code, and in default of the payment of such fine or forfeiture, such person shall be imprisoned in the county jail not to exceed five days, unless such fine or forfeiture is sooner paid.
